Cognosco – Terms of Service

1. About Cognosco

Cognosco is a hobbyist/freelance project operated by an individual in Norway. Cognosco is not a registered company, corporation, or trademark. The service is provided on a personal, non-commercial basis. For legal purposes under GDPR and Norwegian law, the data controller and service operator is:

2. Acceptance of Terms

By creating an account or clicking "I agree" during registration, you confirm that you have read, understood, and accepted these Terms and the Privacy Policy. If you do not agree, do not use the service. We maintain a record of the version you accepted.

3. Use License

You are granted a limited, revocable, non-exclusive license to access and use Cognosco for personal, non-commercial purposes. This does not transfer ownership.

You may not:

  • Modify, copy, or redistribute the materials
  • Use the service or materials for commercial or public display
  • Reverse-engineer or attempt to extract source code
  • Remove proprietary notices
  • Use the service in violation of any applicable law or regulation

4. User Accounts

You must provide accurate, complete information when creating an account. You are responsible for safeguarding your password and all activity under your account. Notify us immediately if you suspect unauthorized access.

5. Content and Intellectual Property

You retain ownership of content you upload or create.

By uploading content, you grant us a worldwide, non-exclusive, royalty-free license to store, process, display, reproduce, and use your content solely for operating and improving the service.

This license ends when you delete the content or your account, except for:

  • Backups retained briefly for operational integrity
  • Logs or metadata retained as required by law or for security

We may remove content that violates these Terms or infringes third-party rights.

6. Prohibited Uses

You may not use Cognosco:

  • In violation of Norwegian or international law
  • To distribute unauthorized advertising or spam
  • To impersonate any person or entity
  • To upload illegal, fraudulent, harmful, or infringing content
  • To upload malicious code, malware, or harmful software
  • To disrupt, overload, or attack the service

7. AI Processing

Cognosco provides AI-powered features. When you use these features, your inputs (text, images, audio, video, or other media) may be transmitted to our third-party AI provider OpenRouter for processing.

OpenRouter processes this data as our data processor under GDPR Article 28.

Our Data Commitments:

  • No AI Training: Your content is never used to train, fine-tune, or improve AI models. Your data is processed solely to generate responses for your immediate use.
  • No Advertising: Your data is never used for advertising purposes, behavioral profiling, or sold to third parties.
  • No Human Review: We do not read, access, or monitor your content unless required by law or a valid legal process.

Important:

  • Your inputs may contain personal data.
  • You should avoid submitting sensitive data (GDPR Article 9) unless necessary.
  • OpenRouter may temporarily log prompts for abuse prevention but does not train on your data.

8. Service Availability

Cognosco is provided "as is" and "as available." We may modify, suspend, or discontinue the service at any time without notice.

9. Disclaimer of Warranties

To the maximum extent permitted by Norwegian law, we disclaim all warranties, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

If you are a consumer, nothing in these Terms limits your statutory rights under Norwegian consumer law or the Digital Content and Services Act.

10. Limitation of Liability

To the fullest extent permitted by law, we are not liable for indirect or consequential damages (including loss of data, profit, or business interruption).

We do not exclude liability for:

  • Death or personal injury caused by negligence
  • Fraud
  • Any liability that cannot legally be excluded

11. Indemnification

You agree to indemnify and hold us harmless against third‑party claims arising from:

  • Your violation of these Terms
  • Your unlawful conduct
  • Your upload of content you lack rights to

We will notify you of any such claim and allow reasonable opportunity to defend.

12. Governing Law and Jurisdiction

These Terms are governed by Norwegian law. Disputes will be resolved exclusively by the courts of Norway.

13. Changes to Terms

We may update these Terms from time to time. For significant changes, we will provide notice via email or through the service and request renewed consent if legally required.

14. Severability

If any provision is found invalid, the remainder of these Terms continues in full force.
